Banyak pertanyaan yang muncul, seperti:<\/p>\n<ul>\n<li>&#8220;Bukankah nama bisnis sudah menjadi merek dagang setelah daftar di SSM?&#8221;<\/li>\n<li>&#8220;Apakah mendaftarkan di SSM saja tidak cukup?&#8221;<\/li>\n<li>&#8220;Setelah mendaftar di SSM, apakah saya masih harus mendaftarkan di MyIPO?&#8221;<\/li>\n<\/ul>\n<p>Untuk menjawab pertanyaan ini, mari kita mulai dengan menjelaskan perbedaan antara pendaftaran bisnis dan pendaftaran merek dagang.<\/p>\n<h3>Apa Perbedaan antara Merek Dagang dan Nama Perusahaan?<\/h3>\n<p>Merek dagang untuk nama bisnis dan nama bisnis atau perusahaan adalah dua hal yang berbeda. Mari kita lihat situasinya di Malaysia.<\/p>\n<h4>1. <strong>Aspek Hukum<\/strong><\/h4>\n<p>Pendaftaran bisnis (misalnya, perseorangan\/kemitraan atau Persekutuan Liabilitas Terbatas) atau perusahaan (Sdn. Bhd.) dan pendaftaran merek dagang diatur oleh hukum yang berbeda. Pendaftaran bisnis diatur oleh <strong>Undang-Undang Pendaftaran Bisnis 1956<\/strong>, sedangkan merek dagang diatur oleh <strong>Undang-Undang Merek Dagang 1976<\/strong>.<\/p>\n<h4>2. <strong>Badan Pengatur dan Penegakan<\/strong><\/h4>\n<p>Pendaftaran bisnis atau perusahaan dapat dilakukan melalui <strong>SSM<\/strong> (Suruhanjaya Syarikat Malaysia), sedangkan pendaftaran merek dagang dilakukan melalui <strong>MyIPO<\/strong> (Perbadanan Harta Intelek Malaysia).<\/p>\n<h4>3. <strong>Kewajiban Pendaftaran<\/strong><\/h4>\n<p>Pendaftaran bisnis atau perusahaan <strong>wajib<\/strong> dilakukan jika Anda ingin menjalankan bisnis di Malaysia. Pendaftaran merek dagang <strong>tidak wajib<\/strong>, tetapi sangat disarankan untuk melindungi bisnis Anda.<\/p>\n<h4>4. <strong>Nama Bisnis\/Perusahaan vs. Merek Dagang<\/strong><\/h4>\n<p>Nama yang dipilih untuk bisnis atau perusahaan Anda harus unik dan <strong>tidak identik<\/strong> dengan nama bisnis atau perusahaan lain. Namun, nama yang <strong>mirip<\/strong> masih dapat diterima dalam pendaftaran bisnis atau perusahaan.<\/p>\n<p>Sebagai contoh, <strong>PETRONAS DAGANG<\/strong> bisa didaftarkan meskipun <strong>PETRONAS<\/strong> sudah terdaftar sebagai nama perusahaan. Demikian juga, <strong>ADIBAS Sdn. Bhd.<\/strong> bisa didaftarkan meskipun ada <strong>ADIDAS<\/strong>.<\/p>\n<p>Sebaliknya, nama, kata, logo, angka, atau merek yang akan didaftarkan sebagai merek dagang <strong>tidak boleh sama atau bahkan mirip<\/strong> dengan merek dagang yang sudah terdaftar. Misalnya, <strong>ADIBAS<\/strong> bisa ditolak pendaftarannya karena bunyinya mirip dengan <strong>ADIDAS<\/strong>.<\/p>\n<p>Ada kasus di mana perusahaan menghadapi tindakan hukum karena menggunakan merek dagang yang terlalu mirip dengan yang sudah ada. Sebagai contoh, penggunaan merek <strong>Chipsplus<\/strong> mendapat tindakan hukum karena <strong>Chipsmore<\/strong> sudah terdaftar.<\/p>\n<h4>5. <strong>Penggunaan Nama Perusahaan vs. Merek Dagang<\/strong><\/h4>\n<p>Pendaftaran nama bisnis atau perusahaan bertujuan agar Anda dapat <strong>menjalankan bisnis secara legal<\/strong> di Malaysia. Pendaftaran merek dagang, di sisi lain, memberi Anda <strong>hak eksklusif<\/strong> atas merek dagang tersebut menurut hukum. Setelah merek dagang terdaftar, Anda memiliki <strong>hak moral dan ekonomi<\/strong> atasnya.<\/p>\n<p>Pihak lain tidak dapat menggunakan merek dagang Anda tanpa izin. Jika mereka menggunakannya, mereka memerlukan izin Anda dan mungkin harus membayar biaya lisensi.<\/p>\n<h3>Apakah Saya Perlu Mendaftarkan Merek Dagang Setelah Daftar di SSM?<\/h3>\n<p>Jadi, setelah mendaftarkan bisnis atau perusahaan Anda di SSM, apakah Anda masih perlu mendaftarkan merek dagang? Jawabannya adalah <strong>YA<\/strong>! Apakah mendaftar di SSM saja sudah cukup? <strong>TIDAK<\/strong>! Mengapa?<\/p>\n<p>Karena kedua hal tersebut memiliki <strong>tujuan yang berbeda<\/strong>.
